So can anyone tell me if I can sell cmsimple themes ? Is this allowed by the license ?

You can buy their themes which allows You to remove the backlink.

yes, it is absolute ok
with GPL-licenses (read them deeply again please) it is allowed to use software under this license and to modify it
if you keep the rights, don't remove the links or copyrights...
but if you write templates from scratch, this is your work, you deliver "added value"
if you deliver your designs together with the complete CMSimple Distribution, you should keep that intact and add your templates and that is not against the license
that's the same model as with http://www.cmsimple-styles.com/ and their styles-club
with GPL-licenses (read them deeply again please) it is allowed to use software under this license and to modify it

just to make it clear: CMSimple's AGPL license says that every software modifying CMSimple has to be kept under AGPL license as well. That means, every template, every plugin, every addon, every other bit of CMSimple software will modify CMSimple and has to be kept under AGPL license. You cannot run it under GPL.

can you explain what is "modifying CMSimple" ?
A template? Yes, of course.
A plugin? Yes?
So what about JAT's payware or code encrypted plugins?
I pay for one of JAT's plugins, use it in CMSimple and then I have to provide a download of his code?

Sorry, I can't understand "modifying CMSimple".
Modifying CMSimple - IMHO - means modifying the CMSimple core, not CMSimples output.

Well, i would not consider templates, scripts or plugins as modifications of CMSimple. The CMS a tool designed to ship out web pages, and it is one of its features to be extensible in these ways (BTW: in an overly strict sense even modifying content.htm would be such modification, wouldn't it?); it provides standardized interfaces for this purpose. If You redistribute this as a package, You have to keep the original CMSimple package intact. Doing so is an easy thing; any mod can easiliy be installed separately, e.g. by a script.
So for my understanding of the GNU licenses it is definitely possible to use xGPLed software in connection with commercial added value.
